Understanding the Mandates of Senate Enrolled Act 459
Effective July 1, 2025, this new law is not optional. If you are a community water system serving 500+ people, a publicly owned treatment works, or a designated semipublic facility, you are now legally required to:
Conduct Annual Vulnerability Assessments
Perform a comprehensive cybersecurity assessment at least once per calendar year using a state-approved framework.
Submit Biennial Certification (Starting 2026)
By December 31 of every even-numbered year, you must formally certify that you have completed your assessment, documented plans to mitigate risks, and updated emergency response plans.
Implement 24-Hour Incident Reporting
Report any cybersecurity incident that impacts operations to the Indiana Office of Technology within 24 hours of discovery.
Designate a Primary Reporter
Annually provide the state with the name of the individual responsible for cybersecurity incident reporting.
